What Happens After We Receive Your Notice

Upon receiving a valid and complete DMCA notice, we will take the following steps in accordance with the DMCA provisions.

We will promptly investigate the claim and review the allegedly infringing material. We take all valid copyright claims seriously and will conduct a thorough review of each notice we receive.

If we determine that the material identified in your notice is indeed infringing and your notice meets all legal requirements, we will remove or disable access to the allegedly infringing material. We aim to complete this process as quickly as possible.

We will make a good faith attempt to notify the user who posted the material that we have removed or disabled access to it. This notification will include information about the DMCA process and the user’s right to file a counter-notice if they believe the removal was in error.

Counter-Notification Process

If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification. This is your legal right under the DMCA.

Your counter-notification must include certain required information to be valid. You must provide your physical or electronic signature, just as the original complainant must do.

Identify the material that was removed or disabled and the location where it appeared before it was removed. Be specific about what content you are referring to and where it was located on our website.

Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification. This is a serious legal declaration.

Provide your name, address, and telephone number. What Happens After a Counter-Notification

If we receive a valid counter-notification, we will forward it to the party who filed the original DMCA notice. That party will then have ten business days to notify us that they have filed a court action seeking to restrain you from engaging in the infringing activity.

If we do not receive notice of such court action within ten business days, we may restore the removed material or cease disabling access to it. The timing and our response will be in accordance with DMCA requirements.

Repeat Infringer Policy

We maintain a policy of terminating, in appropriate circumstances, the accounts or access of users who are repeat infringers of copyright. We reserve the right to disable access to our website for any user who repeatedly infringes the copyrights of others.

We track DMCA notices and counter-notifications to identify patterns of infringement. Users who repeatedly post infringing content may have their ability to contribute content restricted or eliminated entirely.

Misrepresentation and False Claims

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing or was removed or disabled by mistake or misidentification may be subject to liability.

This means that if you make false claims in a DMCA notice or counter-notification, you could face legal consequences including damages and attorney fees. Only file a DMCA notice if you genuinely believe that your copyright has been infringed.

Similarly, only file a counter-notification if you genuinely believe that the material was removed or disabled by mistake or misidentification. Making false statements in these legal documents can have serious consequences.
